Strict and specific laws exist regarding Working Alone – see below for more information.
Provincial and Federal Regulations:
Alberta | British Columbia | Canada [CCOHS]
Canada has both Federal and Provincial regulations to protect lone workers, workers in isolation and/or dangerous environments. Companies and individuals who fail to comply with these regulations can experience increased insurance premiums, fines, legal action or even criminal charges. By deploying a lone worker monitoring solution, businesses often meet or exceed regional legislation and can optimize their communication and process execution when paired with an intrinsically safe, ruggedized Sonim phone, Xplore tablet or an inReach Satellite communicator.
Fines can range based on first offence and subsequence offences with some provinces including a per day fine for outstanding infractions. Fines are steep and go as high as $1 000 000 for a first offence and can be levied against the corporation as well as the individuals responsible for enforcing the program.
Excerpt from Alberta Occupational Health and SafetyCode — Part 28, Working Alone Section 393:
Working Alone is a hazard
Occupational Health and Safety Officers inspecting a workplace will evaluate compliance with the OHS Act and OHS Code. the following are excerpts of the Guide.
An employee is considered to be working alone if the employee works alone at a work site in circumstances where assistance is not readily available when needed.
In a working alone situation the employer MUST:
(1) Conduct a hazard assessment
(2) Eliminate or reduce the risks
(3) Provide an effective communication system for employees to contact other people who can respond to the employees’ need. The system must include regular contact by a responsible supervisor at intervals appropriate to the nature of the hazard
(4) Ensure employees are trained and educated
Do you have an effective means of communication for employees to contact persons capable of responding when employees need immediate assistance?
Part 28 Working Alone Section 393 applies if:
(a) a worker is working alone at a work site, and
(b) assistance is not readily available if there is an emergency
394(1) An employer must, provide an effective communication system consisting of (a) radio communication, landline, cellular telephone or satellite communication, that includes regular contact by the employer or designate at intervals appropriate to the nature of the hazard.
